Bankruptcy and Creditors’ Rights
The Nelson Mullins Bankruptcy and Creditors’ Rights Practice involves the representation of creditors, debtors, landlords, asset sellers and purchasers, trustees, and committees in bankruptcy courts across the United States, and in parallel proceedings in foreign jurisdictions. Firm attorneys also represent creditors in asserting their rights in state and federal courts across the country.
This practice area developed through the representation of the firm’s institutional lending clients and in cooperation with the Financial Institutions Practice. Nelson Mullins assists clients engaged in banking, mortgage banking, asset-based lending, inventory floor planning, equipment finance, and corporate trust in loan workout and restructuring, default enforcement, and bankruptcy situations.
Firm attorneys have represented multi-location retailers, manufacturers, distributors, service companies and computer hardware/software developers in workouts, reorganizations and liquidations. Nelson Mullins has enjoyed successful results in real estate related reorganizations for developers, owners, contractors and suppliers. The firm also has extensive experience in bankruptcy proceedings involving businesses in the manufacturing and service sectors. Nelson Mullins attorneys have completed the reorganization of a major home health care provider and its 31 subsidiaries. The debtors in this matter had 15,000 employees in 22 states and more than $600 million in assets and liabilities. The plan was confirmed and a merger consummated less than a year from the date of filing.
Firm members have been involved in the representation of committees in major Chapter 11 cases, in industries as diverse as publishing, arms manufacturing and airlines. Nelson Mullins represented the Committee of Unsecured Creditors in a Chapter 11 bankruptcy case involving 26 golf resorts, $1.5 billion in assets and $1.1 billion in liabilities. The unsecured creditors received 100 percent payment in that case. Our attorneys also represented committee members in a national case involving $1 billion in senior debt, plus trade and asbestos-related environmental liabilities, as well as a case that involved a publicly held diaper manufacturer with $2 billion in liabilities.
In cooperation with the Nelson Mullins Mergers and Acquisitions Practice Group, firm attorneys regularly are involved in structuring, documenting, and, when necessary, litigating, the purchase and sale of insolvent businesses and assets, in and outside of the bankruptcy courts. Nelson Mullins has been involved in acquisitions of long-term care and assisted living facilities, and businesses involved in trucking, maritime maintenance, software, lighting manufacture and distribution, as well as the divestiture of assets of a major textile manufacturer and distributor.
Various members of the Firm participate in the organized Bar as officers and directors. Our attorneys have been actively involved in drafting or commenting upon Local Rules for the Bankruptcy Courts for the Northern District of Georgia and the District of South Carolina as well as the Federal Rules of Bankruptcy Procedure. Nelson Mullins’ attorneys currently assist the federal trial courts with the pilot electronic filing and document retrieval system.
